Additional Terms and Conditions

  1. Neither CXO Media, Inc. ("CXO") nor Intel is responsible for any entries that are misdirected, lost, not received or are ineligible. Neither CXO nor Intel is responsible for telephone, modem, or fax failure, or for incomplete, garbled or delayed online or facsimile transmission or other errors of any kind, whether human, mechanical or electronic. Entry materials that have been tampered with or altered are void. Late or incomplete entries will not be eligible.
  2. All entries become the property of CXO and Intel and will not be acknowledged or returned.
  3. CXO and Intel shall be the sole arbiters in all matters relating to the Award Program and the interpretation of these Program Rules. The decisions of CXO and Intel shall be final and binding. CXO and Intel reserve the right to disqualify any entries that CXO and Intel determine, in their sole discretion, to be in violation of any term contained in these Program Rules.
  4. Each entrant represents, warrants and agrees that it owns the rights to all materials supplied in connection with an awards entry and/or has the right and permission to supply such materials, and such materials do not and will not defame, infringe or violate the trademark, copyright, patent or privacy rights or any other rights or any third party and are not the subject of any actual or threatened litigation or claim. Entrant shall indemnify CXO and Intel and their affiliated entities, assigns and licensees against any loss, cost or damage (including reasonable attorneys' fees) arising out of or in connection with any breach of any of the aforesaid representations, warranties or agreements.
  5. An entry into this Awards program constitutes entrant’s irrevocable and perpetual permission and consent, without further compensation or attribution, to use such Submission for editorial, advertising and publicity purposes by the Sponsor and/or others authorized by the Sponsor, in any and all media now in existence or hereinafter created, throughout the world, for the duration of the copyright in the Submission. Sponsor and/or others authorized by the Sponsor shall have the right to reasonably edit, adapt, and modify the Submission for purposes of this contest.
  6. If for any reason the Awards are not capable of being awarded as planned due to acts beyond the control of CXO and Intel, including acts of force majeure, acts of war, domestic terrorism, fraud, technical failures, or any other causes beyond the control of CXO and Intel, CXO and Intel reserve the right, in their sole discretion, to suspend or cancel the Awards Program at any time.
  7. These Program Rules shall be governed by the laws of the Commonwealth of Massachusetts without regard to its conflicts of laws principles and any action shall take place in the courts of the Commonwealth of Massachusetts.
  8. Limits of liability: By participating in the Intel Premier IT Knowledge Awards program, you agree that CXO and Intel, their parent, subsidiaries, affiliates, employees, agents and representatives, will have no responsibility whatsoever for losses or damage of any kind that result from acceptance, possession, or use of the award or entry in the Intel Premier IT Knowledge Awards program, and you further agree to release and hold harmless CXO and Intel, its parent, subsidiaries, affiliates, employees, agents and representatives from any losses, damages, claims, and liabilities arising in connection therewith. Without limiting the foregoing, CXO and Intel will not be liable for: (a) Late, lost, incomplete, or improperly transmitted entries, notices, forms, or other correspondence; (b) Any electronic, network, or other technical error, malfunction, or unavailability; (c) Any conditions caused by events beyond CXO’s or Intel’s reasonable control; and (d) Any printing or typographical errors in materials associated with the Intel Premier IT Knowledge Awards program. CXO and Intel reserve the right, in their sole discretion, to suspend or cancel the Intel Premier IT Awards program at any time if any technical problem or outside tampering, or any acts beyond the reasonable control of CXO and Intel corrupts the administration, security, or proper submission of entries of the Intel Premier IT Knowledge Awards program.
